Sword Hidden in Bike – Possession of a Deadly Weapon in AZ?

A 37-year-old man from Magna, Utah has been charged after authorities say he was smuggling a samurai sword inside his bicycle while riding through town. A criminal complaint was filed and the man was arrested and charged with possession of a dangerous weapon by a restricted person (man has a criminal conviction and is banned from possessing a weapons). If you find yourself charged with the possession of a deadly weapon in AZ, it might be time to hire a good Arizona weapons attorney. Here’s why…

Weapons charges shouldn’t be taken lightly. They are very serious charges, and even a possession of a concealed weapon conviction may result in mandatory jail time. Furthermore, the Arizona law is clear; a dangerous weapon isn’t always a firearm. The law states that anything that can be used in a manner to cause serious injury or death is a weapon including a crow bar, a fist, or, in this case, a samurai sword. And like this guy, being in possession of a weapon while your right to possess one has been restricted (usually due to a felony conviction) can also result in a charge of misconduct involving weapons. In Arizona this is a Class 4 Felony. Serious, life changing charges.

It sounds like this guy needs a criminal defense attorney in his corner and you might as well if you have recently been charged with a crime involving a weapon. Visit our website for more information on weapons crimes and for a free consult regarding any criminal charge, call 602-685-1122 or fill out the consultation request form below.

Arizona ICE Official Arrested on Drug Possession Charges

An Immigration and Customs Enforcement (ICE) official was recently arrested in Pinal County after a high-speed chase with police officers where the ICE officer allegedly tossed 10 bundles of marijuana out of the window of his agency vehicle, a DPS spokesperson said.

Jason Lowery, the arrested ICE officer, had been under investigation for weeks after officials received a tip from a drug smuggler about his involvement in the drug ring.

The chase ended when Lowery rolled his vehicle after the 45 minute chase. Another 4 bundles of marijuana were found in the vehicle upon further inspection. Lowery was booked into the Pinal County jail for drug smuggling and for fleeing from officers.

It’s No Longer Illegal to Abuse a Spouse if You’re in Topeka, Kansas. When do you need a AZ domestic violence lawyer?

It’s no longer illegal to abuse your spouse if you’re in Topeka, Kansas. The Topeka City Council voted on Oct. 12th to repeal the city’s misdemeanor domestic battery law, mostly due to concerns and issues with the city budget. Felony domestic abuse cases continue to be prosecuted. What about here in Arizona? What are the domestic violence laws in AZ? When do you need a AZ domestic violence lawyer?

Arizona’s domestic violence laws (Arizona Revised Statute 13–3601) apply not only to crimes against spouses, but also against partners, former partners, those living together, people who are dating, family members, relatives and the elderly. Physical assault, such as hitting, does NOT need to occur for domestic violence charges to be filed.

In Arizona, many actions can be designated domestic violence including:

• Intentionally or recklessly causing injury or touching with intent to cause injury. (Physical Violence/Assault)

• Disturbing the peace of your neighborhood or disturbing the peace of a person. (Disorderly conduct)

• Damaging something that has any value. (Criminal Damage)

• Violating a restraining order or order of protection. (Violating protective orders)

• Name calling, put downs, threats, intimidation, isolation. (Verbal, mental and emotional abuse)

• Financial control. (Economic abuse)

Domestic violence cases in Arizona can be charged as misdemeanors or felonies depending on the jurisdiction and the severity of the crime. Consequences for a conviction are never standard and the court will take many things into consideration when sentencing. Because of this it is important not to take domestic violence charges on alone. Charlie Naegle will bring to light the facts of your case and the facts and evidence involved and will strengthen your position in the process.
