In Arizona, an investigatory stop is unconstitutional. The officer must have reasonable suspicion that criminal activity is involved before making a stop. Therefore, if the officer lacked a constitutionally valid reason for making the routine traffic stop, all evidence of intoxication obtained as a result of the unlawful stop cannot be used as evidence against this individual.
